Terms & Conditions

1. Copyright
Until final payment for services rendered is made, the photographs produced by Jonathan David Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Jonathan David's explicitly written permission. Upon final payment by The Client, limited copyright ownership of the resulting images will be transferred to The Client under the following conditions:

  • The negatives and or slides are the property of The Client for personal use and for the purposes of the reproduction and giving of photographs to friends and relatives.
  • The Client must obtain written permission from and compensate Jonathan David Photography prior to The Client or its friends and relatives publishing or selling the photographs for profit.

2. Reservation & Payment
A signed agreement and Booking Fee are required to reserve the specified coverage of Jonathan David Photography.
The Booking Fee will be 30% of the total invoice. The remaining balance is payable in full two weeks prior to the event or project date. The Booking Fee is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. Cancellation within two weeks of the wedding or event will also result in payment in full. All cancellations must be in writing. Weddings and Events that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time. All cheques to be made payable to Jonathan David Hakim. Bank Transfer/Paypal payment is available by arrangement.

3. Pre-Event Consultation:
For Weddings, The parties agree to a pre-event consultation two to three weeks before the event date in order to finalise the actual shooting times, locations, and The Client's request list (in writing) for specific photographs.

4. Cooperation:
The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Jonathan David Photography recommends that The Client designate an "event guide" to point out important individuals for informal or candid photographs to the photographer during the event that they wish to have photographed. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs.

Jonathan David Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Jonathan David Photography.

5. Shooting Time/Additions
The photography schedule and selected methodology are designed to accomplish the goals and wishes of The Client in a manner enjoyed by all parties. The Client and Jonathan David Photography agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time.

6. House Rules:
The photographer is limited by the guidelines of the ceremony official or reception site management. The Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is The Client's responsibility; Jonathan David Photography will offer technical recommendations only.

7. Exhibition:
Requests for specific negatives or slides to be used by Jonathan David Photography may be requested at a future time. The Client grants Jonathan David Photography permission to display selected images resulting from this assignment as an example of Jonathan David Photography's work and for entrance into photographic competitions and release all claims to profits that may arise from use of images.

8. Limit of Liability:
In the unlikely event that the photographer is injured or becomes too ill to photograph the event, Jonathan David Photography will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package.

Jonathan David Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Jonathan David Photography's control, Jonathan David Photography's liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

 

9. Post-Production:
Unless specifically offered, post-production of photographs does not include airbrushing all the package photos. Processing and enhancing the photographs includes, but is not limited to, manipulating the photos to fix technical aspects like exposure, contrast, white balance, saturation as well as manipulating colour tones (e.g. sepia, black and white). Airbrushing photographs can be offered if requested, and will be incorporated into the package quote and price.

10. Completion Schedule:
Finalised digital post-processing and DVD creation takes approximately 4 weeks (depending on duration of event). Following this time, if an album or prints have been ordered, a consultion will be required in order to select The Client's favourite shots for inclusion into the album and enlargement.
